Species protection exemption and exemption: grant

The aim and task of species protection is the conservation of animal and plant species protected by law and the protection of their habitats and biotopes. Any act that leads to the impairment, concern or destruction of the aforementioned protected goods is prohibited by the Law on Nature Conservation and Landscape Conservation (BNatSchG).

An exemption may be granted on request if this is necessary for reasons of overriding public interest (including social or economic interest) or if the implementation of the provision is necessary in individual cases as an unintended hardship and the deviation is compatible with the concerns of nature conservation and landscape conservation.

The granting of exemptions and exemptions from species protection provisions concerns:

1. in connection with specially protected species

  • Bans on fishing, killing and possession
  • the keeping and trade of specimens of specially protected species
  • the identification of specimens of specially protected species

2. in connection with species not specifically protected

  • authorisation to collect wild plants and live animals commercially, unless hunting or fishing law is in place
