Exemption from the observance of the night's rest for events: granting

The period from 10 p.m. to 6 a.m. is defined as the night-time rest period in Germany. During this time, activities that could disturb the night's rest are prohibited.

However, this prohibition does not apply

• to measures to prevent or eliminate an emergency situation and
• for facilities operated on the basis of special permits and for harvesting and tilling work between 5:00 a.m. and 6:00 a.m. and between 10:00 p.m. and 11:00 p.m.

Events are generally subject to approval via other legal areas.

The competent licensing authority may allow exceptions to the ban upon application after consultation with the competent authority under immission control law. These apply if carrying out the activity at night is in the public interest or in the particular interest of one of the parties involved. The exception should be granted under certain conditions to protect the neighborhood and the general public from noise or be subject to conditions. Such exemptions can be granted for the operation of outdoor seating areas and for trade fairs, markets, public festivals and similar events. A public need generally exists if an event serves to maintain historical or cultural customs or is otherwise of particular importance to the community.
