Development plan
Before you make more detailed plans on how you will build on a plot of land that you have purchased or want to purchase, you should clarify what the associated development plan says.
The qualified development plan sets out in a legally binding manner which buildings and other structures are permitted on a plot of land. Determinations are made, among other things
- the type of building use (e.g. residential, mixed, commercial area),
- the extent of building use (e.g. number of storeys and floor space, height, number of full storeys),
- the construction method (open or closed construction method),
- the buildable plot area
- the local traffic areas.
The simple development plan, which does not meet the requirements of a qualified development plan, only contains individual stipulations as binding regulations and is supplemented by the regulations of the applicable Sections 34 and 35 of the German Building Code (BauGB).
Who should I contact?
A development plan is adopted by the municipality as a statute. It then becomes legally binding through publication.
For more information, you can contact the planning office of your municipality or the building supervisory authority of the municipality or district.
