Report conclusion of the land lease agreement
As the lessor of agricultural land, you must notify the competent authority of the conclusion of a land lease agreement. As a tenant, you can also notify the competent authority.
If the competent authority finds the following conditions during the inspection, it can object to and cancel the land lease agreement:
- the land lease agreement concluded leads to an unhealthy distribution of land, in particular an accumulation of land,
- this results in uneconomic fragmentation or
- the lease price is unreasonably high.
Which documents are required?
- completed application "Notification of conclusion of land lease agreement"
- a copy of the concluded written land lease agreement or
- in the case of an orally concluded land lease agreement: the notification of content
Requirements
- You must have concluded a land lease agreement.
- The land lease agreement must not
- no unhealthy distribution of land, in particular accumulation of land,
- no uneconomic fragmentation or
- cause an unreasonably high lease price.
- Land lease agreements for agricultural land smaller than 0.5 hectares are exempt from the notification requirement.

There are no costs.

What deadlines do I have to pay attention to?
The land lease is valid if you have not received a notice of objection after one month or after an extension to two months.
Constructive Approval: 1 - 2 MonthsYou must notify the competent authority of the land lease agreement one month after signing it.
Appeal
- Application to the competent district court for a court ruling against the objection notice
