Test results on levels of undesirable substances in or on foodstuffs: transmission
According to § 44a Abs. 3 of the Food, Consumer Goods and Feed Code (LFGB) in conjunction with the Ordinance on Notification and Transmission Obligations for Substances Not Desirable to Health (MitÜbermitV), food business operators are obliged to report available test results for dioxins, dioxin-like and non-dioxin-like polychlorinated biphenyls to the competent authority. Not only exceedances of maximum levels, but all test results of the substances mentioned in § 1 of the MitÜbermitV are subject to notification.
Who should I contact?
The responsibility lies with the district, the independent city, the Hanover region and the Zweckverband Veterinäramt Jade Weser.

Applications / forms
Electronic samples in Excel format, so-called "digital files" according to MitÜbermitV, are to be used for the messages. The format must not be changed. There is a sample file for food business operator communications, which you can download from the links provided.
The notifications shall be sent electronically to the competent authority. Investigation reports can be attached as an electronic document in pdf or office format. In exceptional cases, the competent authority may, on request, accept the written form.

What deadlines do I have to pay attention to?
The notification must be made within fourteen days of the trader becoming aware of the results of the investigation. This is only the case when the result of the investigation has been definitively determined.
The notification shall be made immediately if a maximum level laid down in the LFGB, a regulation adopted on the basis of the LFGB or in a directly applicable legal act of the European Community or of the European Union has been exceeded.
What else should I know?
A violation of the obligation to communicate the results of the investigation (non-notification, incorrect, incomplete or late notification) constitutes an administrative offence and can be punished with a fine of up to 20,000.00 euros.
