Application for planning documents for the preparation of a development plan or land use plan
For orderly urban development and land use, urban land-use plans are a planning measure of urban land-use planning.
Urban land-use planning includes the land-use plan (preparatory urban land-use planning) and the development plan (binding urban land-use planning).
Maps at a scale of 1:5,000 or smaller form the basis as a planning document for preparatory urban land-use planning, in which the current or planned use of the entire municipal area is shown.
The development plan as a binding urban land-use plan is developed from the land-use plan and, as a municipal statute, contains legally binding, specific, plot-specific stipulations on the type and extent of building use.
Planning documents for the development plan are created on the basis of the Official Real Estate Cadastre Information System (ALKIS) with its parcels and buildings. They should be produced at a scale of 1:1,000. In exceptional cases, planning documents at a scale of 1:500 or 1:2,000 may be used.
Depending on the requirements, the plan documents must include
- carry out a site comparison to determine the completeness of the official maps,
- measure buildings and structures,
- determine boundaries and
- other topography such as trees, ditches etc. and the elevation must be measured.
The land registry office, a publicly appointed surveyor or a publicly appointed surveyor certifies the plan document as required:
- Information on the status of the plan document
- completeness of the significant urban development structures and roads etc.
- the geometrically correct representation of the boundaries and structures
- the possibility that the new boundaries to be created can be transferred correctly to the local area.
Who should I contact?
The provision of planning documents and the certification of the completeness, correct representation and transferability of the boundaries to the local area,...) is the responsibility of the locally competent land registry office of the State Office for Geoinformation and Land Surveying of Lower Saxony (LGLN) or a publicly appointed surveyor licensed in Lower Saxony (ÖbVI).

No special requirements are necessary to apply for a planning document.
Which documents are required?
The application must include the exact purpose and therefore also the requirements for the planning document. In particular, it must be specified whether, for example, special requirements are placed on the geometric quality of the planning document. This already influences the necessary scope of work and the costs incurred later.
In addition, the exact boundaries (scope) of the plan document must be specified. This can be done using a digital outline polygon or a map.
What are the fees?
The amount of the fee depends to a large extent on whether a high geometric accuracy of the real estate cadastre must be achieved for the plan document and whether other topography such as trees, ditches etc. and the elevation must be surveyed. This can give rise to surveying activities costing well over 10,000 euros.
The actual costs will only be determined with the notice of performance.
