Which place to enter?

The location is used to determine the responsible office for the selected administrative service. In most cases you can enter your place of residence to find the competent authority. However, there are also cases in which a different location must be specified. Here are some examples:

Birth certificateYou want to get married and need a birth certificate. You live in Hanover, but you were born in Celle. You must therefore state your place of birth, i.e. Celle.

Business registrationYou would like to register a business in Braunschweig. Your place of residence is Hanover. You must therefore state the location of your future business, i.e. Braunschweig.

Apply for a building permitYou would like to build a house in Wunstorf and therefore apply for a building permit. Her place of residence is currently Hanover. You must indicate the place where the house is to be built. In this case it is Wunstorf.

Spatial planning procedure, state planning assessment


The aim of a regional planning procedure is to determine as early as possible - in advance of an approval procedure - whether a major project can be implemented in a spatially and environmentally friendly manner at the location intended by the project developer or in the planned route area. If there are serious alternative locations or routes for a project, these are also examined and evaluated in terms of spatial planning. As a rule, an initial environmental impact assessment is carried out.
Spatial planning procedures can be considered, for example, for large pipeline construction projects or transport projects, but also for spatially significant soil extraction projects, wind farms, leisure facilities, shopping centres, etc.

As a result of the procedure, a state planning assessment is issued, which has the character of an expert opinion for the project developer. It makes it possible to align and optimize further project planning to a suitable location or route.
Public authorities must take into account the result of the regional planning procedure in subsequent planning and measures as well as in decisions on planning approvals. In a later approval procedure, the results of the regional planning procedure can be built upon.

The services provided by the competent body include:

  • Advising project promoters
  • the receipt of applications and notifications in accordance with § 15 of the Regional Planning Act
  • determining whether a project requires a regional planning procedure
  • the implementation of an application conference to coordinate the scope of the investigation and the necessary procedural documents for the regional planning procedure
  • the implementation of the regional planning procedure with the associated participation procedure
  • the state planning assessment of the spatial and environmental compatibility of the project.

In addition to the involvement of public authorities, the procedure also includes public participation. In order for citizens to be able to participate, the procedural documents are made publicly available at the competent authority and made available on the Internet, and the comments are then evaluated.
Only in so-called "accelerated spatial planning procedures" may public participation be omitted. This is only possible in rare exceptional cases for projects for which there is no obligation to carry out an environmental impact assessment.
The final state planning assessment will be made available to the public and made available on the Internet.

Who should I contact?

The responsibility lies with the district and the independent city. In the Hanover area and the surrounding area, this is the Hanover region.
An exception also applies to the area of the districts of Gifhorn, Goslar, Helmstedt, Peine and Wolfenbüttel and the independent cities of Braunschweig, Salzgitter and Wolfsburg. The regional association of the greater Braunschweig area is responsible there.

Which documents are required?

As a rule, the spatial and factual scope of the regional planning procedure is only agreed upon within the framework of an upstream application conference with various authorities. After that, the competent authority determines which procedural documents must be submitted in detail for the regional planning procedure.
As a rule, the following documents are required for a preparatory application conference:

  • Brief description of the project with information on its type and size and associated construction measures, brief description of individual parts or sections of the project, technical illustrations or system sketches, if applicable,
  • Information on the planning status (e.g. on any documents, investigations and expert opinions that may already be available),
  • Information on the planned location of the project with site plan/overview map and on characteristics of the affected area (such as existing uses and previous pollution, ecological significance, protected areas, etc.),
  • Information on any alternative locations or routes and selection criteria, if applicable, results of an initial spatial resistance analysis to exclude less suitable locations or routes,
  • a brief description of the general (typical) effects of the project as well as the concrete effects on affected spatial planning requirements (e.g. on priority and reserved areas), other land uses and environmental protection assets,
  • Proposals for the content design and spatial delimitation of the study framework, for the methodology and data basis of the spatial impact study to be prepared and the EIA report to be prepared.

If you merely indicate that you wish to pursue a spatially significant project without a prior spatial planning procedure, the competent authority will check whether a spatial planning procedure is actually dispensable. As a rule, the information described above - with the exception of the latter point - is required for this.

What are the fees?

Fees are charged in accordance with the Ordinance on Fees and Expenses for Official Acts and Services (AllGO).

The costs result from the scope and complexity of the procedure and the associated participation procedures. This can result in fees of several tens of thousands of euros.

What deadlines do I have to pay attention to?

Deadlines may have to be observed. Please contact the competent authority.

As a project developer, you must note that the state planning assessment is only valid for a limited period of 5 years; if necessary, an application for an extension must be submitted to the competent authority in good time before the expiry of the period of validity. If an approval procedure for the project is initiated before the expiry of the period of validity, the expiry of the deadline is initially suspended.

What else should I know?

In the case of projects of overriding importance, a higher state planning authority (Office for Regional Development Braunschweig, Leine-Weser, Lüneburg or Weser-Ems) can assume responsibility for the spatial planning procedure. If this is the case, the lower state planning authority can name the competent authority for you.
