Register a business
A trade is any non-socially unacceptable, self-employed, long-term and profit-making activity, carried out in one's own name and for one's own account.
The trade does not include, but is not limited to:
- socially unworthy activities, e.g. clairvoyance,
- primary production, e.g. agriculture and forestry,
- liberal professions, e.g. doctors, lawyers, tax consultants,
- the management of own assets (unless it is a company registered in the commercial register).
The start of an independent operation of a standing trade or the operation of a branch or dependent branch office must be registered with the competent authority at the same time as the start.
Businesses that are operated by:
- Sole traders (natural persons)
- partnerships (each partner authorized to represent a partnership is subject to notification)
- in the case of legal entities, the legal entity itself (GmbH, AG)
Who should I contact?
Responsibility lies with the municipality, the joint municipality and the city.
This procedure can also be handled by a "single point of contact". The "Single Point of Contact" is a special service offered by the municipalities and the state for service providers.

Applications / forms
The notification forms prescribed in Section 14 of the Trade Regulation Act (GewO) must be used in the trade notification procedure.

What are the fees?
The amount of the fees is determined in accordance with Annex 1 to Section 1 (1) of the General Fee Regulations of the State of Lower Saxony No. 40.1.2.1- depending on the time spent. However, the maximum fee is EUR 43.00.
Process flow
The tax office, chamber of crafts, chamber of industry and commerce, local court, employers' liability insurance associations and the trade supervisory office, among others, are informed about the trade notification.
Exceptions for trades requiring supervision
When registering the trades listed in Section 38 of the Trade Regulation Act (GewO), the notifying party must immediately apply for a certificate of good conduct (document type O, for submission to an authority) and an extract from the Central Trade Register (document type O, for submission to an authority) to verify their reliability. If both documents are already available (not older than three months), they can be attached directly to the notification. If the person making the notification does not comply with this obligation, the competent authority must obtain the information ex officio. The information will then be sent directly to them and not to the person making the notification.
In the case of traders from another member state of the European Union or another signatory state to the Agreement on the European Economic Area, documents issued in the country of origin that prove that the requirements for reliability are met are sufficient in accordance with Section 13 b GewO. A certified copy of the documents and a certified German translation may be required.
What deadlines do I have to pay attention to?
The business registration must be made at the same time as the start of the standing business or the operation of a (dependent) branch.

What else should I know?
Service providers who fulfill the requirements of Article 4 No. 5 of Directive (EC) No. 2006/123 on services in the internal market within the scope of the Trade Regulation Act (GewO) and therefore do not fall under Section 4 para. 1 sentence 2 GewO are also subject to notification, even if they maintain a branch in another EU Member State. Exceptionally, permanent activities outside a branch or without such a branch may also be subject to notification if they are initiated by the client.
