Exemption from the observance of the night's rest for events: granting

The time from 22:00 to 06:00 is set as the night rest period in Germany. During this time, activities that may lead to a disturbance of the night's rest are prohibited.
 

However, this prohibition shall not apply.

• measures to prevent or remedy an emergency situation, and
• for installations operated on the basis of special permits and for harvesting and cultivation work between 5:00 a.m. and 6:00 a.m. and between 10:00 p.m. and 11:00 p.m.
   

In addition, the competent body may, upon request, grant derogations from the prohibition. These apply if the exercise of the activity during night time is in the public interest or in the particular interest of a participant. The exemption is to be granted or subject to conditions in order to protect the neighbourhood and the general public from noise under certain conditions. Such exemptions may be granted for the operation of outdoor seats, for the night of 31 December to 1 January and for trade fairs, markets, folk festivals and similar events. As a rule, there is a public need if an event serves to cultivate historical or cultural customs or is otherwise of particular municipal importance.
