Permission to operate a prostitution establishment
An application for a permit to operate a prostitution business must be submitted to the competent authority. (Subject to permission)
Section 12 (1) of the Prostitute Protection Act (ProstSchG):
The operation of a prostitution establishment requires the permission of the competent authority. The permit can be limited in time.
The licence shall be renewed upon application if the conditions relevant to the grant of the licence continue to apply.
Section 12 (2) of the Prostitute Protection Act (ProstSchG):
The licence for the operation of a prostitution establishment is granted at the same time for a specific operating concept and for certain buildings, facilities and rooms located therein.

If the conditions are met, there is a legal entitlement to the issuance of a licence to operate a prostitution business.

Legal capacity of the applicant.
According to §§ 14, 15 ProstSchG, the applicant or the person intended as deputy or manager must have the necessary reliability.
As a rule, the required reliability is not given if the person fulfils a characteristic listed in §15 (1) ProstSchG.
Pursuant to Paragraph 16(1) of the ProstSchG, the operating concept must describe the essential characteristics of the business and the precautions to be taken to comply with the obligations under this Act.
§ 16 (2) ProstSchG lists the essential aspects that must be set out in the operating concept.

Which documents are required?
In order to obtain a permit pursuant to Section 12 (1) of the Prostitute Protection Act, the following documents must be attached to the application in accordance with Section 12 (5) of the Prostitute Protection Act:
1. the operating concept,
2. the other necessary documents and information on the
Proof of compliance with the licensing requirements and
3. the name, date of birth and address of the person for whom the
the authorisation is applied for, or from a legal person
or association of persons whose company name, address, number of the register sheet in the commercial register and their registered office.
The licensing authority will provide information on which additional documents must be submitted.
Process flow
In order to obtain a permit, an application must be submitted:
- An application must be submitted to the competent authority using the prescribed forms and attaching the required documents.
- The submitted documents will be checked for completeness and conclusiveness.
- If necessary, documents will be requested.
- If necessary, an on-site appointment will be arranged.
- A personal meeting is regularly arranged.
- If all requirements are met, permission will be granted. The applicant receives the permit notice.
Otherwise, a rejection notice will be issued.
