Use of sound amplification systems: granting - exemption
Equipment used to generate or reproduce sound (sound equipment), in particular loudspeakers, sound reproducers, musical instruments and similar equipment, may only be used at such a volume that uninvolved persons are not significantly disturbed or the natural environment cannot be adversely affected. If this is not the case, the use of such devices is prohibited on public traffic areas, in public facilities as well as in and on other facilities that serve general use, on tent and campsite sites, in swimming pools and beach pools as well as in the great outdoors.
These requirements do not apply
- audible signals to warn of dangers,
- prescribed signalling and warning devices,
- liturgical bells and
- on devices used in the context of a public transport operation.
There are exceptions for the use of sound equipment for the purpose of election advertising for European, Bundestag, Landtag or local elections in the last six weeks before the election by parties or other political associations.
Upon request, the competent body may grant exceptions in individual cases where there is a public or overriding private interest. The exemption is to be granted under conditions and subject to conditions for the protection of the general public and the neighbourhood. In addition, the competent authority may generally authorise temporary (musical) performances in inner-city pedestrian zones.

What are the fees?
The decision on the application for exemption is subject to a fee. The Fees Ordinance issued on the basis of the Land Fees Act provides for an administrative fee (usually also in the event of refusal to grant a permit).
What deadlines do I have to pay attention to?
The exemption should be requested in good time before the claim. The time limits are laid down in the Administrative Regulations.
Applications / forms
The "Application for exemption for the operation of sound equipment (and for disturbance of the night's rest)" must be submitted to your competent authority.
Who should I contact?
The responsibility lies with the municipality, the Joint Community and the city and depends on the reason for the respective application for exemption.
