Exemption for the use of work equipment between 20:00 and 7:00: grant

Relevant regulations on the operation of motor-driven machinery, tools and garden equipment are contained in the Law on the Protection against Harmful Environmental Effects from Air Pollution, Noise, Vibration and Similar Processes (BImSchG) in Connection with the 32nd Ordinance on the Implementation of the Federal Immission Protection Act (32nd BImSchV).

In principle, these regulations are aimed at both entrepreneurs and private individuals.
Thus, in accordance with Section 7 (1) No. 1 of the 32nd BImSchV devices and machines may be

  • pure, general and special residential areas,
  • Small settlement areas,
  • Special areas for recreation,
  • spa and clinic areas as well as
  • on the premises of hospitals and nursing homes

do not operate outdoors on Sundays and public holidays, all day of the day, from 20:00 to 7:00.

There are special rules for

  • Cutters,
  • Grass trimmers and grass edge cutters,
  • leaf blowers as well as leaf collectors,

which do not bear the Community eco-label (European eco-label) or do not comply with the requirements for the permissible level of level II in Article 12 of Directive 2000/14/EC.

These may also be used in the period between

  • 7:00 a.m. and 9:00 a.m.,
  • 1:00 p.m. and 3:00 p.m. and
  • 5 and 8 p.m.

not be operated.

In individual cases, the competent authority may allow exceptions to the limitations of Section 7(1) of the 32nd BImSchV.

According to Section 7(2) of the 32nd BImSchV, approval is not required if the operation of the equipment and machines is necessary in individual cases to avert a danger in the event of severe weather or snowfall or to avert any other danger to humans, the environment or tangible goods.
