Operation of a public scale: display
If you use a public scale, you have:
- to mark the public scale with an external lyre with the clearly legible inscription:
- "Public scale, weighing range of ... kg to ... kg";
- the word 'balance' may be accompanied by indications as to the nature of the balance, its intended use or its holder;
- the start and cessation of the operation of a public scale to the competent authority without delay.
Anyone who uses a public scale must ensure that:
- these are carried out conscientiously and impartially, and
- they are rejected if the user of the public balance, the operating personnel carrying out the weighing or one of their relatives within the meaning of Paragraph 383 (1) (1) to 3 of the Code of Civil Procedure (ZPO) have a direct interest in the weighing result.
Anyone who uses a public scale must ensure that the weighing result is certified by the signature of the person who determined it himself.
The following information must be included in the certificate:
- the indication that the weighing is public,
- Place and date of weighing,
- the principal of the weighing,
- the type of weighing material,
- when weighing motor vehicles or trailers, the number plate,
- in the case of an actual scale equipped with a counter,
- the status of the counter before and after the public weighing, as well as
- the determined weighing result.
Any body of public balance must keep the documents relating to the certified public weighing for a period of two years, calculated from the date of termination of the weighing.
The responsibility lies with the offices of the state enterprise Mess- und Eichwesen Niedersachsen (MEN).
The MEN itself has the national tasks. It is subject to the legal and technical supervision of the Lower Saxony Ministry of Economic Affairs, Labour and Transport.
This procedure can also be carried out through a "single point of contact". The "Single Contact Person" is a special service offered by the municipalities and the country for service providers.
No documents are required.
There are no charges.
No deadlines need to be observed.
