Exemption from night rest for events: grant

The time from 22:00 to 06:00 is set as a night rest time in Germany. During this time, activities are prohibited which may lead to a disturbance of the night's rest.

However, this prohibition does not apply

  • measures to prevent or eliminate an emergency, and
  • for installations operated on the basis of special permits and for harvesting and ordering work between 5:00 a.m. and 6:00 a.m. and between 10:00 p.m. and 11:00 p.m.

In addition, the competent authority may, on request, authorise exemptions from the prohibition. These are the case where the exercise of the activity during the night is in the public interest or is in the particular interest of a party. The exemption is intended to protect the neighbourhood and the general public from noise under certain conditions or to be subject to conditions. Such exemptions may be granted for the operation of outdoor seating, for the night of 31 December to 1 January and for trade fairs, markets, folk festivals and similar events. A public need usually exists when an event serves the maintenance of historical or cultural customs or is otherwise of particular municipal importance.
