Delivery deadline for surpluses from the realisation of pledges in the pawnbroking business: extension

In the pawnbroking business, pawnbrokers may only accept a pledge if, among other things, they have agreed with the pledger that they are entitled, two years after the end of the year in which the pledge was realised, the part of the proceeds that is not due to the pawnbroker as satisfaction and has not been paid to the pledger, to be paid to the competent authority.

If such an agreement has been concluded and the date to be determined thereafter has been reached, surpluses must be paid to the competent authority after one month at the latest so that this part of the proceeds is forfeited. Upon application to the competent authority, this period may be extended for good cause.

The responsibility lies with the district, the district-free city, the large independent city and the independent municipality.

What are the fees?

The amount of the fees is determined - according to Annex 1 to § 1 paragraph 1 of the General Fee Schedule of the State of Lower Saxony No. 40.2 - depending on the time spent. However, a maximum of EUR 68.00 will be charged.
