Clearance certificate for games with the possibility of winning

The clearance certificate is issued to the manufacturer of a game if it is a game device that is produced in series. He will then receive an imprint of the clearance certificate for each replica of the playing equipment. In all other cases, it will be granted to the organizer of the game. The clearance certificate shall contain the following information:

  • Name of the game
  • Company name and registered office of the manufacturer or name, date of birth, place of birth and place of residence of the organizer
  • Description of the game and the gameplay, possibly with illustrations and overview drawings
  • Rules of the game and winning plan
  • List of places where you are allowed to host the game
  • Period of validity of the clearance certificate
  • possibly ancillary provisions

Clearance certificates may also be issued for a limited period or subject to conditions.

The clearance certificate shall be refused if:

  • there is a risk that the player will suffer unreasonably high losses in a short period of time, or
  • the game can be organized as unauthorized gambling within the meaning of § 284 of the Criminal Code (StGB) by changing the playing conditions or by changing the gaming facilities by simple means.
    This is particularly the case if:
    • they are card, dice or ball games that are derived from a game of chance within the meaning of § 284 StGB or
    • the game cannot be operated economically according to the conditions submitted for examination.

Who should I contact?

Responsibility lies with the Federal Criminal Police Office.

This procedure can also be handled through a "point of single contact". The "Point of Single Contact" is a special service offered by the municipalities and the state for service providers.

Requirements

  • Skill game, no gambling
    • A game of skill exists when, according to the game setup and the rules of the game, the player can determine the outcome of the game with a high degree of probability through skill.
  • if the game equipment is to be produced in series
    • Ensuring that the replicas conform to the model tested by the competent body

Additional documents may need to be provided upon request. In the case of a gaming facility, the competent authority may require that a ready-to-use facility is also submitted or that a sample of the playing facility or individual parts thereof be provided to the competent authority.

Fees are charged in accordance with § 6 ordinance on the issuance of clearance certificates (UnbBeschErtV).

What deadlines do I have to pay attention to?

Applications / forms

The application must be submitted to the competent authority. For reasons of legal certainty, it should be submitted in writing in the mutual interest. It is advisable to sign the application. This also corresponds to the qualified electronic signature.

The competent authority decides on the application together with the Physikalisch-Technische Bundesanstalt and a committee of four detectives from the Federal States with experience in the field of gaming.

What else should I know?

The clearance certificate may be withdrawn or revoked if:

  • subsequently, reasons become known that would have precluded the exhibition,
  • the applicant modifies the characteristics of approved gaming establishments, or
  • he organises a game declared harmless under unauthorised conditions.
