Application for authorisation for the use of plant protection products outside agricultural, forestry or horticultural areas
Plant protection products shall not be used on paved open land or on other outdoor areas which are not used for agricultural, forestry or horticultural purposes.
The competent authority may authorise derogations from the prohibition on the use of authorised plant protection products where the intended purpose is urgent and cannot be achieved with reasonable effort in any other way and where overriding public interests, in particular the protection of human and animal health or the natural balance, do not preclude it.
The application for an exemption permit may be submitted by the owner or the user of the areas to be treated or by a person commissioned by him/her.
Process flow
In particular, the application for a derogation shall contain the following particulars and documents:
- Name, address Authorised disposer/beneficial owner of the land
- Identification of all users with address and their certificates of competence in copy
- List of the areas applied for with site plan
- Indication of the active substance/plant protection product intended for use
- Justification for the need for the use of plant protection products
- Information on critical areas / areas at risk of run-off
Who should I contact?
The responsibility lies with the Chamber of Agriculture of Lower Saxony - Plant Protection Office.
Requirements
- The intended purpose is urgent and
- cannot be achieved in any other way with reasonable effort, and
- predominantly public interests, in particular the protection of animal and plant species, do not preclude this.
Which documents are required?
Double-sided copies of the certificate of competence (credit card) and location(s) of the application and its surroundings (corresponding map material/corresponding property maps) must be attached.

What deadlines do I have to pay attention to?
Without exception, an exemption permit is granted for a limited period of one year.
Deletion after completion of the processing with a notice period of 15 years.

An action may be brought against the decision before the competent administrative court within one month of notification.
