Certificate of good standing for games with the possibility of winning Issue


The clearance certificate is issued to the manufacturer of a game if it is a gaming device that is mass-produced. He will then receive a copy of the clearance certificate for each replica of the game equipment. In all other cases, it will be granted to the organizer of the game. The clearance certificate shall contain the following information:

  • Name of the game
  • Company name and registered office of the manufacturer or name, date of birth, place of birth and place of residence of the organiser
  • Description of the game and the gameplay, possibly with illustrations and overview drawings
  • Game Rules and Winning Plan
  • List of places where you are allowed to host the game
  • Period of validity of the clearance certificate
  • possibly ancillary provisions

Clearance certificates may also be issued for a limited period or subject to conditions.

The clearance certificate shall be refused if:

  • there is a risk that the player will suffer unreasonably high losses in a short period of time or
  • the game can be organised as unauthorised games of chance within the meaning of § 284 of the Criminal Code (StGB) by changing the conditions of the game or by changing the gaming facility by simple means.
    This is particularly the case where:
    • they are card, dice or ball games derived from a game of chance within the meaning of § 284 StGB or
    • the game cannot be operated economically under the conditions submitted for review.

The responsibility lies with the Federal Criminal Police Office.

This procedure can also be carried out through a "Point of Single Contact". The "Point of Single Contact" is a special service offered by municipalities and the state for service providers.

  • Game of skill, not gambling
    • A game of skill exists when the player can determine the outcome of the game with a high probability by skill after the game setup and the rules of the game.
  • if the play equipment is to be mass-produced
    • Ensuring that replicas conform to the specimen examined by the competent body

  • if required by the type of game:
    • Calculation of payout and hit expectation

Additional documents may need to be provided upon request. In the case of gaming facilities, the competent authority may require that a ready-to-use facility be submitted or that a sample of the gaming facility or individual parts thereof be provided to the competent body.  

There are fees according to § 6 of the Ordinance on the Issue of Clearance Certificates (UnbBeschErtV).

The application shall be submitted to the competent authority. For reasons of legal certainty, it should be submitted in writing in the mutual interest. It is advisable to sign the application. This also corresponds to the qualified electronic signature.

The competent authority decides on the application together with the Physikalisch-Technische Bundesanstalt and a committee of four criminal officers of the Länder experienced in the field of gaming.

The clearance certificate may be withdrawn or revoked if:

  • reasons that would have precluded the exhibition become known retrospectively,
  • the applicant modifies the characteristics of authorised gaming establishments, or
  • he organises a game declared safe under unauthorised conditions.
