Approval of experts for cross-checks
In the case of official sampling, a part of the sample or a second piece of the same type must be left at the establishment or person to be sampled. This sample is officially closed or sealed.
If you, as a private laboratory, would like to examine such a counter sample and/or second sample on behalf of a company, you will require a license for this activity. This can be applied for at the Lower Saxony State Office for Consumer Protection and Food Safety.
Who should I contact?
Responsibility lies with the Lower Saxony State Office for Consumer Protection and Food Safety (LAVES), Department 21.
This procedure can also be handled by a "Single Point of Contact". The "Single Point of Contact" is a special service offered by the municipalities and the state for service providers.
Requirements
You may only be approved as a cross-checking expert if you
- are a food chemist with a state examination to become a state-certified food chemist or
- are a licensed veterinarian with a qualification as a specialist veterinarian in the field of investigation applied for approval or a specialist veterinarian for public veterinary medicine or
- have a university degree in natural sciences and can provide evidence of relevant specialist and legal knowledge in the form of suitable documents. If necessary, you must explain the documents to the competent authority.
An authorization also requires that you
- be able to provide evidence of two years of testing and assessment experience in the field of investigation applied for, taking into account the requirements specified in Annex 1 of the GPV
- have a testing laboratory in accordance with § 5 GPV (ISO 17025 accredited) that has the appropriate accreditation for the area of investigation applied for

The informal application should contain the following information:
- Name and address of the expert(s) and the company for which the expert is working
- Contact details of the expert(s) and the company
- Address of the expert(s) and the company
- Type of activity of the expert(s) and the company
Which documents are required?
- Written or electronic application for admission
- Content of the application:
- Address of your head office
- Address of your test laboratory
- Registration number of your test laboratory
- Curriculum vitae of the cross-check expert to be approved
- Declaration that no criminal proceedings or investigations by the public prosecutor's office are pending
- Police clearance certificate
- Declaration that the activity as a cross-check expert can be carried out independently and free of any conflict of interest
- The informal application should contain the following information:
- Name and address of the expert(s) and the company for which the expert is working

- Proof that you meet the requirements
- You are welcome to use Annex 1 to Section 2 (1) of the Cross-check Ordinance - GPV and Annex 3 to Section 3 (5) of the Cross-check Ordinance - GPV

Process flow
You can apply for admission in writing or electronically:
- Submit your application with the required supporting documents.
- You will receive a notification of receipt.
- The documents will be checked by the competent authority. If necessary, further evidence will be requested.
- Once the documents submitted have been checked, you will receive either approval or rejection of your application by post.
The approved cross-checking experts are published on the websites of the LAVES and the Federal Office of Consumer Protection and Food Safety.
Processing duration
You will receive your admission or rejection within one month of receipt of all documents.

An appeal against the decision can be filed within one month.
